In SES v Intelsat court case on C-band proceeds, emails and testimony to embarrass both sides

PARIS — Previously redacted or sealed emails and transcripts of testimony in the trial on whether Intelsat breached a 50-50 C-band proceeds sharing agreement with SES offer a window into what the court will review to decide the issue. Neither company comes away unscathed.

SES alleges Intelsat unjustly profited from U.S. regulators’ decision to award Intelsat $420.8 million more in C-band clearing incentive payments than what Intelsat would have received in an even division of the proceeds with SES.
